  Last line sounds like a contradiction?
I tried to reproduce the issue with FreeBSD 8.2 client and  Linux 3.2.27 server on links with dumb switches and could not. Even when the arp cache entry for that client was long gone (verfied) the server acted correctly on the next poll. 
What OSs are your client and server?
